Liability Waiver
Serving clients is the single most important priority of Cottage & Casita. Client satisfaction resulting in our impeccable reputation is paramount to our success. All efforts are made to not only satisfy clients, but to exceed their every expectation. Full transparency with clients is the standard of service to ensure clients feel the value of their partnership with us. To be trusted with their homes, vehicles, and loved ones is a monumental responsibility that is never taken lightly. Confidentiality is critical to establishing trust, and forging healthy relationships to understand clients needs and wants.
The possibility of services being impeded due to circumstances beyond the control of Cottage & Casita, may arise in worst case scenarios. Though Cottage & Casita will make every possible effort to keep clients satisfied regardless of the situation, rare occurrences can be insurmountable.
Please read and sign below to secure services with Cottage & Casita, and rest assured every possible effort will be made to prevent the following situations, for both the benefit of our valued clients as well as Cottage & Casita, thank you.
General
Mention of Cottage & Casita in this waver includes Gina Garcia and any employee or volunteer in her charge. Acts of God, extreme weather events, animal damage and/or attacks, either wild, domestic, or personal pet interfering with ongoing projects, clients, contactors, sub-contractors, or unrelated persons affected by any unforeseen event are not the fault or responsibility of Cottage and Casita.
Interior Design
Cottage and Casita is not liable for any unforeseen circumstances including but not limited to the following scenarios. The hired contractor discontinuing services, or falling behind their estimated project completion time as well as the quality of service of the contactor and /or subcontractors and lack of warranty if not provided directly by the contractor. Projects taking longer and costing more than estimated and expected. If the client changes their mind after production has begun, or there is a personal conflict with the client regarding services. Cottage & Casita is not liable for any moneys paid to the contractors, and billing up to the date of cancelled or disputed services is due within 48 hours of cancelation or pause of services. Furniture and accessory business may incorrectly fulfill an order, or promise goods that can not be delivered. Warranty on all purchased goods and services including delivery and installation are not the liability of Cottage & Casita, grievances must be handled directly through the independent businesses. Any injuries incurred throughout the design process, physical, emotional, and/or mental for clients and non-clients including third party workers and employees of other business’ are not the responsibility of Cottage & Casita. Both the client and Cottage & Casita can terminate their working agreement at any time without notice. Billing up to termination is required to be paid within 48 hours of advisement.
Hospitality
Cottage & Casita takes all precautions to follow the FDA food handlers’ instructions on safe handling of foods. Food born illness and/or burns are not the fault or responsibility of Cottage & Casita. There are no allergen precautions for any foods provided by Cottage & Casita. Any injuries including choking and death are not the fault or responsibility of Cottage & Casita. If a client is unsatisfied with any aspect of their food or experience, it does not excuse them from payment of goods and/or services rendered. If ingredients for an order are not available, or any subcontracted service fails in any way to provide and/or fulfill any order, Cottage & Casita is not responsible. Client’s consumption of alcoholic beverages, and any actions resulting in intoxicated behavior is not the responsibility of Cottage & Casita. We reserve the right to deny further alcoholic consumption to guests, and refusal of services at any time for any reason. Overnight guests must respect house rules including staying within the public and private spaces clearly designated to guests, and not to enter the concierge's private space. Interior cameras are in use in public spaces for the protection of Cottage &Casita's personal safety and asset security. There are no visual or audio recordings in guest's private rooms. Client damage to property and assets including company vehicle, interior, and exterior of the property, as well as personal injury to Gina Garcia, her staff, and / or volunteers will be the sole financial responsibility of the client. Personal injury inflicted upon Gina Garcia while serving the client due to intended, direct physical assault from the client, their household members, guests, and / or pets is the sole financial responsibility of the client to compensate for injuries and damage to personal property.

Concierge
When Cottage & Casita is driving their own vehicle or a vehicle provided by the client, they are not responsible for any damages to the client, non-clients, their vehicle, personal belongings, or any physical, mental, or emotional trauma as well as any vehicle parked and unattended. The car camera is to be in use at all times while the vehicle is moving, voice recording only turned off if verbally requested on camera. Data will be saved for 30 days. A personal camera will be used unless the client denies it verbally on camera. Incorrect information including destination, appointment time, or any other information needed to fulfil the clients request within a reasonable amount of estimated time is not the fault or responsibility of Cottage & Casita. If any appointments or destinations have unexpectedly rescheduled or closed, services must be paid in full. Cottage & Casita does not provide any medical service or oversite, if a medical emergency occurs, they will call 911 and are not responsible for any costs resulting in contacting authorities or medical personnel. If attempting to assist the client results in physical, mental, or emotional trauma Cottage and Casita is not liable. Cottage and Casita will not tolerate abuse of any kind, physical, emotional, verbal, or otherwise. The client will be immediately returned to their home, a safe location, or authorities will be called. Services will be terminated, and any costs incurred up to termination are required to be paid within 48 hours. Cottage and Casita is not responsible for personal injuries and/or damage to property, public or private. Refunds of services rendered are not provided. Cottage and Casita, Gina Garcia and any employees or volunteers under her name may not be sued for any reason and is exempt from any lawsuits against them. Cottage & Casita takes their client’s privacy very seriously, and will not divulge any conversations, personal information, or recorded visual or audio files unless legally forced. Any property lent by Cottage and Casita that is not returned within the contracted time will be billed for client reimbursement for monetary fair market value of the item(s) and payment is due within 48 hours of billing.
